General Terms and Conditions of Sale – Precious Metals Purchasing
1. Acceptance of Terms
By using our company’s services, whether online, by telephone, email, text message, or through social media platforms, you fully accept these General Terms and Conditions. These terms form the contractual basis of all transactions conducted with our company.
2. Definitions
To avoid any ambiguity, the following terms shall have the meanings indicated below:
Indicative Price: Any estimate or price indication communicated prior to the physical evaluation of precious metals.
Final Price: The price determined after physical evaluation by our experts and accepted by the client.
Physical Evaluation: Inspection, weighing, and analysis of precious metals by our qualified personnel.
Transformation / Melting: Any operation involving the melting, refining, or modification of precious metals after purchase.
3. Price Estimates and Conditions
Any estimate, indication, or price offer communicated by our company, whether in person, by telephone, email, text message, or through social media platforms (including Facebook, Instagram, or any other platform), is provided for informational purposes only and does not constitute a binding commitment to sell or purchase.
Due to the fluctuating nature of precious metals markets, the price of gold and other metals may change at any time without notice. Therefore, the final purchase or sale price is determined only after physical evaluation of the items by our experts.
4. Validity of Estimates / “Best Price” Protection
Any estimate or price indication expires immediately after being communicated. No price is guaranteed unless:
The client has submitted the precious metals for physical evaluation, and
Payment for the transaction has been completed.
Even if the client repeatedly requests the “best price,” all indications remain non-binding. The client may not claim a previously indicated price or dispute the transaction based on a prior estimate.
5. Formation of Contract
The purchase agreement is formed only after:
The physical evaluation of the precious metals by our qualified personnel, and
The client’s acceptance of the communicated final price.
Prior to this stage, no contractual obligation arises from any estimate provided.
6. Final Purchase and Irrevocability
Once the purchase is confirmed and the precious metals are received by our company for transformation (melting, refining, or any other operation):
The transaction is considered final and irrevocable.
The client may not reverse the sale, request a refund, or demand the return of the items, even if precious metal prices increase afterward.
7. Payment and Terms
Payment is made after acceptance of the final price and physical receipt of the precious metals.
Payment methods (bank transfer, cash, or otherwise) are specified during transaction confirmation.
No partial payment creates any right to reclaim the metals or dispute the price after finalization.
All transactions are conducted in United States dollars (USD).
8. Inspection / Verification
All precious metals submitted or presented for purchase are physically inspected, weighed, and tested by our experts prior to the completion of any transaction. The sale is based solely on this physical evaluation.
9. Anti-Fraud / Compliance, Identification and Refusal of Service
Identification Required: For all transactions, the client must provide a valid government-issued identification document (provincial or federal) including name, photograph, and date of birth. No transaction will be completed without presentation and verification of such identification. This requirement complies with provincial and federal laws regarding the sale of precious metals and anti-money laundering regulations.
Fraud Prevention and Compliance: We reserve the right to refuse any suspicious transaction, including any attempt involving fraud, money laundering, or violation of federal or provincial laws concerning precious metals.
Refusal of Service: We also reserve the right to refuse the purchase of precious metals from any individual for any reason whatsoever, including non-compliance with our terms, abusive behavior, or illegal activity. This right may be exercised without prior notice and without obligation to justify such refusal to the client.
10. Market Fluctuation
Due to the nature of precious metals markets:
Prices may fluctuate at any time without notice.
Any repeated request for pricing or “best price” does not create any entitlement for the client to a specific price before the transaction is finalized.
11. Liability and Legal Warranties
We strive to provide accurate evaluations, but we do not guarantee that any indicative price will correspond to the final price.
Except where otherwise permitted by law, these conditions do not exclude the legal warranties provided under the Civil Code of Québec or the Consumer Protection Act.
We are not responsible for any loss or damage arising from the use of the website, social media platforms, or communications made prior to the evaluation and acceptance of the final price.
12. Governing Law and Jurisdiction
These General Terms and Conditions are governed by:
Applicable federal and state laws of the United States, including, without limitation, laws relating to the sale of goods, precious metals, and anti-money laundering regulations.
Any dispute shall be submitted to the competent courts of the State of Florida, United States.
13. Data Protection and Contact
Personal information communicated during the evaluation or shipment of precious metals is protected in accordance with applicable legislation.
We will not disclose such information to third parties, except for the completion of the transaction or where required by law.
